Identification, acceptance and access to the website and mobile application
These General Conditions regulate the access, navigation, and use of the mobile application “BBC MUZZY” and its web support [www.muzzyclub.com] (hereinafter collectively referred to as “the Platform”), owned by BBC MUZZY LLC (hereinafter, “BMU”) with legal address at 2530 Camelot Ct, Hollywood, FL 33026 USA.
- Access to the Platform implies acceptance of these General Conditions of Use, as well as the different modifications and/or additional legal texts that BMU may include in the future. If you have any questions, you can contact BMU at the following email address: [subscriptions@muzzylearning.com. The User declares to have full capacity to understand and accept the content of these Conditions. Access to the Platform will be completely free. However, to contract the services, the User must register.
- Purpose: The Platform has been developed by BMU to offer Users the possibility of contracting the BBC MUZZY course. BBC MUZZY is an English course focused on the effective learning of knowledge of various languages through didactic content in different formats, including audiovisuals.
- Services: The contracting and enjoyment of the BBC MUZZY course can be done through the Platform. The BBC MUZZY Application can be downloaded from the App Store for Apple users, or from Google Play for Android users, as well as from other digital application stores. In any case, the contracting of the BBC MUZZY course will always take place between the user and DIGI, with the Platform being solely responsible for the service and its contents as well as its maintenance. The support service will be provided exclusively through the Platform. The contracting of the BBC MUZZY course service grants the user a personal license to use this service, which will not be transferable in any case, except with the express and written authorization of DIGI. Please note that the use of the BBC MUZZY service requires compatible devices, Internet access, and may also require periodic updates. Additionally, BMU will provide Users with customer service, including a technical support service and resolution of general queries related to the operation of the BBC MUZZY service. Users can direct their queries to the email address indicated in section 1 of these General Conditions. Notwithstanding the provisions of these General Conditions, BMU may establish specific conditions for certain services, which will in any case be specified and communicated to the User.
- Contracting the BBC MUZZY course: subscription and economic conditions
- Subscription Process and Duration: To contract the BBC MUZZY service, prior registration of the User, acceptance of these General Conditions, and the Privacy Policy will be required. The contracting of BBC MUZZY will consist of a monthly, quarterly, semi-annual, or annual subscription, according to the prices and fees established on the Platform at the time of contracting. In this sense, the User must make an initial payment for the amount established on the Platform, with which their subscription for the initial period described on the platform will be formalized. After the initial subscription period, the contracted subscription will be tacitly renewed for new periods equal to the initially contracted one and indefinitely, unless the User communicates their intention to terminate or cancel the subscription according to the procedure established in section 5 of these General Conditions. After contracting the BBC MUZZY service by sending the registration form, Users will receive a confirmation email confirming the charge for the contracted service.
- Prices and Payment Conditions: i) In case of contracting or renewing the BBC MUZZY service through the Apple Store, the payment and billing conditions of this provider will apply. ii) In case of contracting or renewing the BBC MUZZY service through Google Play, the payment conditions of Google Play will apply, but BMU will bill the User for the contracted services according to the billing conditions described in point iii) of this clause. iii) In case of contracting or renewing the BBC MUZZY service through this Platform, the economic and billing conditions of BMU indicated below will apply: The prices will be those indicated by BMU through the Platform at the time of contracting the service. BMU will also inform the User about the applicable taxes, indicating before contracting the total price of the services to be paid periodically. The payment corresponding to the initial period can be made by debit or credit card, following the instructions offered during the payment process steps. Once the initial period has elapsed, and as long as the User has not canceled their subscription, the User accepts that the subsequent subscription fees will be charged monthly, quarterly, semi-annually, or annually by BMU directly to the User, according to the amounts agreed upon at the time of contracting. In this sense, the User authorizes BMU to store their payment data and information and to charge the amounts (including taxes) corresponding to the subsequent subscription fees. The charge for the subsequent subscription fees will occur on the same day of the following period to the period in which the previous contracting or renewal occurred. Users are guaranteed that the payment process is carried out with absolute security, according to the security protocols and services required. The User must notify BMU of any undue or fraudulent charge on the card or payment method used for the purchase via email to [subscriptions@muzzylearning.com, as soon as possible so that BMU can take appropriate action.
- Cancellations: i) In case of contracting or renewing the BBC MUZZY service through the App Store or Google Play, the cancellation conditions of these providers will apply.

- Android device users (Google Play): [31](https://support.google.com/googleplay/answer/7018481?co=GENIE.Platform%3DAndroid&hl=es) ii) In case of contracting or renewing the BBC MUZZY service through the Platform, the BMU cancellation conditions indicated below will apply: accessing the user's personal account and canceling the subscription or sending an email to [subscriptions@muzzylearning.com](mailto:subscriptions@muzzylearning.com). Users can process their withdrawal or cancellation of the BBC MUZZY service subscription at any time, notifying through the same means in which they registered, at least 48 hours before the end of the current monthly, quarterly, semi-annual, or annual subscription period, so that BMU does not make charges for the next quarter, semester, or year. Access to the course will remain active and allow continued enjoyment of the full Content until the end of the contracted quarter, semester, or year. The cancellation will take effect the day after the last day of the current subscription period, so BMU will not charge for the next subscription period. However, BMU will not refund the amounts that have already been charged to the User.
- Exclusion of the right of withdrawal: In accordance with the provisions of article 103.a) of the General Law for the Defense of Consumers and Users of Spain, the right of withdrawal will not apply to contracts that refer to “The provision of services, once the service has been fully executed, when the execution has begun, with the prior express consent of the consumer and user and with the acknowledgment by them that they are aware that, once the contract has been fully executed by the entrepreneur, they will have lost their right of withdrawal.” Therefore, Users will not have the possibility to exercise their right of withdrawal over the contracted service and, as a result, BMU may reserve the right not to refund the amounts paid by Users once they have accepted these General Conditions.
- User account: Each User will have an account with which they can access the Platform and the Content offered by DIGI. The User can register on the Platform and create their user account using their email username and password. The User will be entirely responsible for maintaining the confidentiality and security of their account and all activities that occur in or through their account and is obliged to immediately notify BMU of any security breach of their account. BMU will not be responsible for any loss or damage resulting from unauthorized use of Users' accounts. The User is obliged to provide correct and complete information when registering on the BBC MUZZY Platform, as well as to update that information to ensure it is always correct. The User will be responsible at all times for the custody of their password to access their User account, assuming consequently any damages that may arise from its improper use, as well as from its transfer, disclosure, or loss, and must immediately inform BMU if they have reason to believe that their password has been used unauthorizedly or is likely to be. In any case, access and/or use of the BBC MUZZY service carried out under the registered User's password will be deemed to be carried out by that User, who will be responsible in any case for such access and use.
- Use of the platform: The Platform may provide access to a multitude of texts, graphics, drawings, designs, codes, software, photographs, images, expressions, and information belonging to BMU or third parties to which the User may have access. The User assumes responsibility for the use of the Platform and undertakes to make lawful, diligent, honest, and correct use of any information or content they have access to through the Platform, all under the principles of good faith and always respecting the current legality and this legal text. By way of example, but not limited to, Users must not: i. Register or communicate data that is not true, accurate, complete, and/or updated, nor access the BBC MUZZY service using the name, identification data, or access keys of another User or impersonate any person or identity. Likewise, the User is responsible for communicating to BMU any modification and/or variation of any of the data communicated to BMU. ii. Maliciously or intentionally cause damage or harm that may impair, alter the Platform, nor introduce or spread computer viruses that may produce unauthorized alterations of the contents or systems that make up the Platform. The User must not scan or test the vulnerability of any DIGI system or network, or breach any security or authentication measure, as well as attempt to decipher or disassemble the software used by BMU to offer services through the Platform. iii. Use the Platform for fraudulent purposes or related to criminal offenses or illegal activities of any kind. iv. Reproduce, copy, distribute, transform, or modify the information and content hosted on the Platform, unless they have the authorization of the holder of the corresponding rights. v. Use the Platform to send, use, or reuse material that contains illegal, offensive, pornographic, abusive, indecent, defamatory, obscene, or threatening information of any kind, or that constitutes a violation of copyright, trademarks, or confidentiality, privacy, or any other right, or is otherwise injurious or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising content, and, in general, any type of unnecessary inconvenience or annoyance. vi. Download, send, or distribute in any other way content or applications that may violate any current legislation or that imply infringing any right of any party. vii. Promote or encourage third parties to carry out any of the above practices or contribute to them. BMU will have the right to investigate and report any of the mentioned behaviors according to the Law, as well as to collaborate with the authorities in the investigation of such actions.
- Intellectual and industrial property: All rights over the content, design, and source code of this Platform and, in particular, by way of example, but not limited to, all rights over photographs, images, texts, logos, designs, trademarks, trade names, data included in the Platform, and any other intellectual and industrial property rights are owned by BMU and/or the British Broadcasting Corporation (BBC), or by third parties who have expressly authorized BMU to use them in the provision of BBC MUZZY services. Therefore, and by virtue of the provisions of Royal Legislative Decree 1/1996 of Spain, of April 12, which approves the revised text of the Intellectual Property Law, regularizing, clarifying, and harmonizing the current legal provisions on the matter (hereinafter, “Intellectual Property Law”), as well as in Law 17/2001, of December 7, on Trademarks and the complementary legislation on intellectual and industrial property, the reproduction, transmission, adaptation, translation, distribution, public communication, including its modality of making available, of all or part of the contents of this Platform, in any medium and by any technical means, is expressly prohibited, unless expressly authorized in writing by BMU. BMU does not grant any license or authorization of use of any kind over its intellectual and industrial property rights or over any other property or right related to the Platform, and in no case will it be understood that the access of Users implies a waiver, transmission, license, or total or partial transfer of such rights by BMU. Any use of these contents not previously authorized by BMU will be considered a serious breach of intellectual or industrial property rights and will give rise to the legally established responsibilities.
- Responsibility and guarantees:
Disclaimer of liability
BMU does not grant any guarantee nor is it responsible, in any case, for damages of any nature that may arise from the use of the Platform by Users. Consequently, BMU does not guarantee that the use that Users may make of the contents and services that may be included in the Platform will comply with these General Conditions, nor that they will do so diligently. BMU cannot guarantee the identity of any other User of the Platform. BMU is exempt from liability for damages caused by errors in the use of the Platform by Users, errors or malfunctions due to other applications, software, or hardware installed autonomously by Users or in case of malfunctions due to autonomous interventions on the Platform by Users and/or third parties, or the learning results that Users may have as a result of using the Platform. Among others, and merely by way of example and not limited to, BMU is not responsible for:
- Breakdowns and incidents caused by the lack of due diligence by the User or by the improper use of the Platform.
- The lack of availability, maintenance, and effective operation of the Platform and/or its services or contents, excluding, to the maximum extent permitted by current legislation, any liability for damages of any kind that may be due to the lack of availability or continuity of the operation of the Platform.
- The content of other Internet pages to which links or hyperlinks placed on the Platform may redirect.
- The existence of viruses, malicious or harmful programs on the Platform.
- The illegal, negligent, fraudulent use, contrary to these General Conditions of Use or good faith, of the Platform or its Contents, by Users, including any infringement of BMU's or third parties' intellectual and/or industrial property rights.
- Cases of force majeure, understood as the failure, suspension, or interruption of services as a result of energy restrictions, suspension, interruption, or blockage of telecommunications or the Internet network, actions or omissions of third parties, telecommunications operators or service, supply, or transport companies, or any other causes or circumstances beyond BMU's control that prevent the normal use of the Platform.
- Reservation of rights: Any User who does not comply with the rules contained in these conditions or makes inappropriate use of the Platform may be excluded from it. BMU also reserves the right to read, preserve, disclose, and access any information that BMU reasonably considers necessary to (i) comply with applicable legislation or any judicial or governmental request or requirement, (ii) enforce these General Conditions, including the investigation of potential violations thereof, (iii) detect, prevent, or manage fraud, security, or technical problems, (iv) respond to User assistance requests, or (v) protect the rights, property, or safety of DIGI, its Users, and the public. In case of non-compliance with the provisions of these General Conditions, BMU may restrict the User's access to part, or all of the services offered through the Platform at any time, with immediate effect.
- Suspension and cancellation of services: BMU may temporarily suspend access to the Platform for maintenance, repair, updating, or improvement operations. However, whenever circumstances allow, BMU will notify the User in advance of the scheduled date for the suspension of services. BMU reserves the right to delete, limit, or prevent access to its Platform when technical difficulties arise due to events or circumstances beyond BMU's control that, in its opinion, diminish or nullify the standard security levels adopted for the proper functioning of the Platform. BMU also assumes no responsibility for the cancellation or suspension of services on the Platform for causes not attributable to it. In any case, BMU undertakes to solve the problems that may arise and to offer all necessary support to the User to reach a quick and satisfactory solution to the incident.
- Hyperlinks: The Platform may contain hyperlinks that allow the user to access third-party platforms or websites. BMU assumes no responsibility for the content, information, or services that may appear on such platforms, which are understood to be offered exclusively for informational purposes by DIGI, and which in no case imply any relationship, acceptance, or endorsement between BMU and the persons or entities holding such content or the owners of the sites where they are found.
- Communications and notifications: The User must send their communications to the email address [subscriptions@muzzylearning.com] or to the following address: 2530 Camelot Ct, Hollywood, FL 33026, USA.
- BMU will send its communications to the email address provided by the User for this purpose when completing the contact details requested by the Platform in the registration form. Each party must communicate any changes in the contact address. In case of omission, communications will be considered correctly received. If the User indicates an incorrect contact address, does not update it, or does not communicate its variations, communications will be considered to have reached their destination, exempting BMU from any activity.
- Jurisdiction and applicable law: For the resolution of any discrepancy, issue, or claim arising directly or indirectly from the interpretation or execution of this Contract, the parties, in accordance with Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, submit to the Courts and Tribunals of the city of Barcelona, Spain. By virtue of the provisions of Regulation (EU) No 524/2013 of the European Parliament and of the Council, of May 21, 2013, on online dispute resolution in consumer matters, BMU informs you that, in case of dispute, Users residing in the European Union may resort to the “Online Dispute Resolution Platform” developed by the European Commission, in order to try to resolve extrajudicially any dispute arising from the provision of services by DIGI. The User can access the “Online Dispute Resolution Platform” through the following link: (http://ec.europa.eu/consumers/odr/)
- Duration and modification: The conditions that are published at the time the User accesses this Platform are understood to be in force. If any provision of these General Conditions is declared unenforceable or invalid, such provision will be limited or eliminated to the minimum extent necessary so that the remaining conditions and obligations remain in full force and effect and binding. BMU may delete, modify, or replace the contents of this document at any time, publishing a notice on its websites or sending a notification through the Platform or by email. These modifications will be valid from their publication on the Platform.
