    We inform you that this website is owned by DIGITAL EDUCATION SA, (hereinafter, "DIGI"), with RUT 217015380014 and registered office at Edificio Draga Inn, Avda Montecarlo y Rambla, Suite 4, Punta del Este, Maldonado, 20100, Uruguay. Access and/or use of the website and the App attributes you the status of user, and you accept, from said access and/or use, this Legal Notice.   2. Website Use
    The User assumes responsibility for the use of the Website, App and WebApp. Both the Website, App and WebApp can provide access to a multitude of texts, graphics, drawings, designs, photographs, multimedia content, and information (hereinafter, "Content") belonging to DIGI or third parties to which the User may have access. The User agrees to make appropriate use of the Contents and Services offered through the Website, App and WebApp, and with an indicative but not limiting character, not to use them to:
    Engage in illegal activities, those contrary to good faith and public order.
    Cause damage to the physical and logical systems of the Website, App and WebApp of DIGI, its suppliers or third parties.
    Introduce or spread computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage.
    Attempt to access, use and/or manipulate data from DIGI third-party suppliers and other users.
    Reproduce or copy, distribute, allow public access through any public communication modality, transform or modify the Contents, unless authorised by DIGI.
    Suppress, hide or manipulate the Contents subject to intellectual or industrial property rights and other identifying data of such rights of DIGI or third parties incorporated into the Contents, as well as technical protection devices or any information mechanisms that may be inserted in the Contents.
    DIGI warns that the materials contained in this Website, App and WebApp have been included for informational purposes only, and are therefore insufficient to make decisions or take positions in a specific case. The User must take into account that the materials contained in this Website, App and WebApp may not reflect the most recent legislative or jurisprudential status on the issues analysed. Likewise, these materials may be modified, developed or updated without prior notice. DIGI shall have the right to investigate and report any of the mentioned behaviours in accordance with the Law, as well as to collaborate with the authorities in the investigation of such actions. DIGI may temporarily suspend and without prior notice, the accessibility to the Website, App and WebApp for maintenance, repair, updating or improvement operations. However, whenever circumstances allow, DIGI will communicate to the User, with sufficient notice, the expected date for the suspension of the Services. DIGI is not responsible for the use that Users may make of the Contents included in the Website, App and WebApp.
  3. Intellectual and Industrial Property
    All intellectual property rights of the content and graphic design of the Website, App and WebApp are the exclusive property of DIGI and/or British Broadcasting Corporation (BBC), or of a third party that has authorised the use thereof, so it is DIGI who has the exclusive right to exploit them. All this, by virtue of the provisions of the applicable legislation regarding Intellectual and Industrial Property Rights. DIGI does not grant any licence or authorisation of use of any kind on its intellectual and industrial property rights or on any other property or right related to the Website, App and/or WebApp, the Services or the Contents thereof. The reproduction and temporary storage of the contents of the Website, App and WebApp is permitted to the extent strictly necessary for its use and viewing from a personal computer and any other device. The legitimacy of the intellectual or industrial property rights corresponding to the Contents provided by users is their exclusive responsibility, so the User will hold DIGI harmless from any claim by third parties derived from the illicit use of Contents on the Website, App and WebApp.

    DIGI declares that it has adopted the necessary measures that, within its possibilities and the state of technology, allow the correct functioning of its Website, App and WebApp, as well as the absence of viruses and harmful components. However, DIGI cannot be held responsible for:
    • The continuity and availability of the Contents and Services.
      The absence of errors in said Contents or the correction of any defect that might occur.
    • The absence of viruses and/or other harmful components.
    • The damages or prejudices caused by any person who violates DIGI's security systems.

    • All personal data processed by Digital Education SA and its affiliated providers with respect to this Privacy Policy are controlled by Digital Education SA and Muzzy Learning UK Ltd., acting as the data controller under the EU and UK data protection laws.
    • If you purchased our services with one of our distributors, each of these distributors will independently be a data controller under the EU data protection laws and local data protection laws that apply to these companies. All service providers will also be individual data controllers. You can access the privacy policy of these providers by contacting them directly.
    • If you purchased other services through the Digital Education SA website, the terms and conditions of the service will apply and you must accept them during the purchase process.

      • When you book our services, you may obtain a username. This reference will appear in the confirmation email. Always keep your username and password confidential.       • Do not share your MuzzyClub personal area login details.
        To keep your private area on our website and mobile applications private, do not share your username and password with anyone.
      • When you finish using our website, online services or mobile applications, log out if someone has access to your computer or device. This is especially important if you are using a public computer.
      • Be careful and take precautions against online fraud and phishing. Phishing is an online practice that involves illegally obtaining personal data through false messages. Unsolicited emails are sent to people included in lists illegally obtained by third parties, and recipients are asked to enter or confirm bank details or passwords on a cloned or fake website.
      • When do we collect your personal data?: We collect your personal data every time you use our services (whether they are provided by us or by other companies or agents acting on our behalf), including when you browse our website or when you interact with us electronically or with our customer service representatives.           We will know if you book services through muzzyclub.com or if you use other sales channels, such as distributors or customer service representatives.
      • Data collected while using our services.
        • We may collect additional and limited information about you when you interact with staff or customer service representatives.
        • Data about your online registration and other interactions.
        • We will store your data to ensure we properly interact with you if you have already registered with us, either through our Digital Education SA Club or another loyalty or customer programme.
        • We will store your data if you participate in a contest or promotion or have interacted with us on social networks such as Facebook and Twitter or others.
        • Data about how you use our website, mobile applications and customer service.
        • To help us customise your data and improve our website, we use cookies and similar technology to collect information about your searches and content you have viewed on our website, such as the website you came from, and banners and links that can be found on the websites of our business partners.
        • We will use the data about website usage stored in cookies to understand you as a customer and thus better tailor our products and services to your needs.
      • What do we use your personal data for?: WE DO NOT SELL YOUR PERSONAL DATA OR THAT OF YOUR CHILDREN. But we do use your personal data for the following purposes:
        • To process all issues related to our services and provide the requested services.
        • To send you status updates and service or operational communications related to the purchased service.

        • We will analyse the way customers use our sales channels, products and services, to better understand how to improve the service we offer and encourage customers to use our full range of products and services.
        • To carry out marketing activities and keep you informed about Digital Education products and services.

        • We may tailor the content of our websites, applications, emails and other communications to ensure they are of interest to you as much as possible, including offers and/or services.
        • To understand your usage preferences and offer you information on course usage, offers and the like.
        • We may combine anonymous data from client-provider relationships with third parties (e.g. Google or Facebook or others) so that both companies can learn more about user behaviour, such as other websites visited.
        • To send you updated information and communications.
          Even if you opt out of marketing information, we may continue to send you communications about the services you purchased. These communications will help you get details about the services purchased and may include additional options and other services you can use.
          We may also send you communications about services you have used, such as if you have had a problem and we want to proactively contact you to resolve it.

      • If you are a Muzzy Club member, you can change your privacy preferences at any time by changing your online profile settings with our distributor or by writing to the Data Protection Officer at dpo@muzzylearning.com
        In addition, all marketing communications you receive by email will include an "unsubscribe" option so you can opt out of receiving them at any time. We try to process unsubscribe requests within 30 business days, so you may continue to receive messages before we actually finish processing your request.
        Please note that even if you tell us that you no longer want to receive marketing communications, you will continue to receive communications (as described above) about the products and services you have purchased or we will send you an update on their status. If you are a MuzzyClub member, we will continue to send you information about issues that affect your membership and club services. If you ask us to stop sending you marketing communications, please note that we will keep your personal data to indicate that you do not want to receive marketing communications.
    • What is the legal basis for processing your personal data?
      • Digital Education SA will only process your personal data when there is a legal basis to do so. The legal basis will depend on the reason or reasons of Digital Education SA to collect and use your data. According to EU and local data protection laws, in almost all cases the legal basis will be the following:
        • Because we have to use your data to process your purchases.
        • Because your personal information, when used to conduct and improve our business, is one of the legitimate interests of Digital Education SA.
        • Because Digital Education SA needs to use your personal data to comply with a legal obligation.
        • Because you have given your consent to Digital Education SA to use your personal data for a specific purpose.

    • With whom do we share your personal data?
      • We may share your personal data with other companies in the group, which includes BBC, DMP Organization, Muzzy Learning UK. We share information with these companies so they can help us provide services and get to know you better.
        You will only receive marketing emails from other companies in the group when you have given your consent to those companies.
      • We may also provide your personal data to the following third parties, for the purposes described below:
        • Other service providers that are necessary for the provision of services booked by you.
        • If you are a member of Muzzy Club or another partner programme, we will share information with our partners so that we can manage the programme benefits to which you are entitled.
        • In response to legal requirements from the government and police, such as tax authorities.
        • External service providers we hire to provide services such as carrying out marketing initiatives or conducting customer surveys on our behalf.
        • Third parties such as law firms and courts, to enforce or apply a contract with you.
        • Third parties, such as the police and regulatory authorities, to protect our rights, property or the safety of our customers, employees and assets.
        • Third parties to whom we provide website usage data (but not personal data) so they know that you have visited our websites (see "How we use cookies and other ways to collect website data" above).

        • We do not sell your personal data to third parties and only allow third parties to send you marketing communications if you have given your consent.

        • Access: You can request a copy of all your personal data that Digital Education SA has stored. There is no charge for this request, if done twice a year. We may charge a reasonable fee after that.
          If you are a Muzzy Club member, you will be able to access your personal data through your personal account through your local distributor.
        • Rectification: You can rectify your personal data if they are not accurate.
          If you are a Muzzy Club member, you will be able to rectify or edit your personal data through your personal account with your local distributor.
        • Deletion: You can request that your personal data be deleted.
        • Opposition: You can oppose the processing of your data.
        • Restriction of processing: You can request the restriction of processing in the following cases:
          • While the accuracy of your data is being verified after being challenged.
          • When processing is unlawful and you oppose the deletion of your data.
          • When Digital Education SA no longer needs to process your data, but you need them to make or defend claims.
          • When you oppose the processing of your data for carrying out a task carried out in the public interest or to fulfil a legitimate interest, while it is determined whether the legitimate reasons for processing prevail over yours.
        • Portability: You can download an electronic file with all the personal data you have provided us referring to your local distributor and choose other data that have been obtained as a result of your contractual relationship with Digital Education SA and shared with other companies.
          Different local distributors have different requirements to properly identify you before accepting the release of your data. This is to protect you from third parties trying to fraudulently access your information. Please contact them directly.

  1. Duration and Modification
    This Legal Notice shall be in force indefinitely, DIGI being able to make changes to the conditions specified therein, which shall enter into force from the moment of their publication. DIGI may suppress, add or change both the Contents and the Services it provides, as well as the way in which they appear located or presented. The conditions that are published at the time the User accesses the DIGI Website, App and WebApp are understood to be in force. Access and/or use of the Website, App and WebApp shall be understood as an acceptance by the User of this Legal Notice and its conditions and, where appropriate, the changes made to them.
